End-of-Service & Arbitrary Dismissal in Oman: Your Rights (2026)
By HAQQ Research · · 8 min read · mena
Oman's new 2023 Labour Law (RD 53/2023): end-of-service raised to one month per year (Art. 61), notice (Art. 38), and arbitrary-dismissal remedies (Art. 11).
Oman's new 2023 Labour Law (Art. 61) raised end-of-service gratuity to at least one month's basic wage per year of service (on the last basic wage), up from the old 15-day tier. Notice (Art. 38) is 30 days for monthly-paid workers, 15 for others. Arbitrary dismissal is remedied (Art. 11) by reinstatement or 3–12 months' gross wage, plus gratuity. A new expatriate savings scheme is expected to replace the lump sum by mid-2026 — verify timing.
FAQ
How much is end-of-service gratuity in Oman after the 2023 law?
Under Article 61 of the new Labour Law (Royal Decree 53/2023), at least one month's basic wage for each year of service, calculated on the last basic wage, for workers not covered by the Social Protection Law — up from the old 15-day tier.
What is the compensation for arbitrary dismissal in Oman?
Under Article 11, the court orders either reinstatement or compensation of no less than three and no more than twelve months' gross wage, in addition to end-of-service gratuity.
Do I keep my gratuity if I resign in Oman?
Yes. An ordinary resignation does not forfeit the Article 61 gratuity, provided you serve the notice period. In cases of employer breach you may leave without notice and keep full rights (Article 41).
