Kuwait Lease Law 35/1978 (amended 2024): 5-year rent freeze, the 50%-below-market increase rule, eviction grounds, and the Rental Division.
In Kuwait, rent is fixed for the lease and protected by a 5-year freeze; after five years a landlord may raise it only where it sits well below market, up to the market average, and only once every five years, with 3 months' written notice. Eviction is limited to statutory grounds (non-payment, unsafe building, illegal use, unauthorized subletting) and needs a court order. Disputes go to the specialised Rental Division.
FAQ
Can a landlord raise the rent every year in Kuwait?
No. Rent is frozen for 5 years; after that, it can only be raised where it is well below market (around 50%), up to the market average, and only once every 5 years, with 3 months' notice.
Can I be evicted before my lease ends in Kuwait?
Not during the term except for a statutory ground — such as non-payment, an unsafe building, illegal use, or unauthorized subletting — and only by court order.
How much notice must I give not to renew in Kuwait?
15 days if the term is 3 months or less, one month for 3–6 months, and two months for over 6 months.
